PHX man whose son died wants to withdraw plea

A Phoenix man who pleaded guilty to child abuse in the 2013 death of his infant son in a hot car has filed a motion to withdraw his plea.

Brokale Lytte Marques was scheduled to be sentenced Wednesday. Instead, a Maricopa County Superior Court judge told the 31-year-old Marques that the state now has 10 days to review his motion and respond.

Marques was arrested in September 2013 after his 1-year-old son was found at a Scottsdale mall parking lot in a lethargic state.

He told police he left the child in the car because he couldn't find a baby sitter and had to get to work. The boy died later at a hospital.

Marques originally faced second-degree murder in the case before pleading guilty to reduced charges last November.
