Man charged in NAU shooting argues for dismissal

An attorney for the man charged in a fatal shooting at Northern Arizona University is asking a judge to dismiss the indictment or send the case back to the grand jury.

Steven Jones has pleaded not guilty to first-degree murder in the Oct. 9 death of Colin Brough. Three other NAU students were wounded in the shooting.

Jones' attorney, Joshua Davidson, argued in a motion released Tuesday that the prosecution's presentation to grand jurors was biased and violated Jones' due process rights.

Davidson says the state downplayed Jones' self-defense claims, misrepresented statements from victims and failed to mention that Brough punched Jones in the face.

Prosecutors have said Jones was the aggressor in the shooting.

The state has until Feb. 10 to file a response to Davidson's motion.
