The Arizona Supreme Court is expected to decide whether a biological father can challenge his child's adoption though the biological father didn't claim paternity by filing with a state registry.
The justices agreed Tuesday to review a Court of Appeals ruling that set aside a couple's adoption of the child.
The Court of Appeals ruled that the biological father preserved his rights to claim paternity by promptly suing to challenge the adoption once he learned of the adoption proceedings.
That ruling stands in contrast to a 2008 ruling by the Court of Appeals. The 2008 ruling said a man's consent to an adoption wasn't needed because he didn't file a paternity claim with the state registry within a 30-day deadline.
