TEMPE, AZ — A DUI suspect was found passed out in his running car at an Arby's drive-thru in Tempe, according to court paperwork.
Tempe police report that on January 11, at around 11 p.m. Timothy Patrick Byrd, 23, was found passed out behind the wheel of his running car in the drive-thru of an Arby's restaurant near Broadway Road and Hardy Drive.
Byrd allegedly admitted to officers that he had been drinking alcohol earlier that night.
Police say his preliminary breath alcohol test shows his B.A.C. level at .199.
According to court records, Byrd has an active warrant for failing to appear on a previous D.U.I. charge in Phoenix.
He has been charged with aggravated D.U.I.
