Judge approves of Ducey’s method of reopening gyms

Arizona Superior Court Judge Tim Thomason has shown his approval for the way the state is allowing gyms and other businesses to apply to reopen.

Thomason denied a motion Monday by Mountainside Fitness that would have held Arizona Gov. Doug Ducey in contempt of court.

Mountainside filed the motion after Ducey’s team and the Arizona Department of Health Services announced the plan for how gym and fitness centers could reopen.

Mountainside argued that the Ducey administration’s plan did not go along with Thomason’s order that fitness centers and gyms must be provided a meaningful opportunity to be heard and apply for reopening. Because of that belief, the gym chain asked the court to hold Ducey in civil contempt.
