The Arizona Supreme Court has agreed to review a lower court's ruling on consumer rights.

The Court of Appeals' Jan. 29 ruling revived a consumer fraud lawsuit in which a woman said her lupus was caused by an antibiotic prescribed to treat chronic acne.

The Court of Appeals ruling said prescription drugs are sold like other merchandize and that their sales and advertisements are covered by Arizona's consumer protection law.

The ruling also eliminated a legal doctrine shielding manufacturers who provide safety information and warnings to those who sell or distribute products.

The Supreme Court said Tuesday it will schedule oral arguments on the case, which has attracted the interest of groups representing plaintiffs' attorneys and business groups.
