Charges against Mesa shooting suspect upgraded to 2nd-degree murder after victim passes away

A man accused of shooting his girlfriend's former boyfriend is now facing murder charges because the victim has since died.

Charge against Jose Eladio Castro-Valenzuela were recently upgraded to second-degree murder because the victim, Oscar Pacheco, died in the hospital, police said.

On Monday night, police were called to the area of Country Club Drive and Brown Road after receiving reports about a shooting.

When officers arrived, Pacheco was found suffering a gunshot wound. Pacheco was taken to the hospital in critical condition.

Witnesses told investigators that Castro-Valenzuela was seen arguing with the victim before the shooting occurred. The shooting suspect was seen fleeing the area in a truck with a trailer attached. 

According to police, several witnesses identified the suspect as Castro-Valenzuela who was taken into custody the next day. 

The suspect was originally charged with aggravated assault with a deadly weapon.
