The Maricopa County Attorney has until Thursday night, 48 hours by law, to formally charge Marc Payne for the crimes of running down three Phoenix Police officers outside a QuikTrip gas station.
If police had their way, he'll be tried for attempted murder and aggravated assault with a deadly weapon.
A look into Payne’s criminal records read like deja vu. Payne was arrested for aggravated assault after fighting with three Phoenix Police officers in 1997.
It started as a traffic stop for expired plates, he had a warrant out for his arrest and according to the police report, Payne didn't want to go to jail so he punched and kicked the officers.
At the time Payne had a steady job and friends provided character statements for the judge calling him honest and hard working. He eventually got the charges reduced to a misdemeanor and only served one-year of a two year probation sentence for good behavior.
