Leslie Merritt Jr.'s bond was reduced to $0 after evidence revealed the original bullet fragments could not be confirmed to be from Merritt's gun.
DPS had originally contended ballistic evidence linked Merritt to four of the eleven freeway shootings during the summer of 2015.
During Tuesday's hearing, attorney Jason Lamm said to the judge, "He is no more the 1-10 freeway shooter than, respectfully, you are."
Next court date in State v Leslie Merritt Jr is a status conference on May 18th before Judge Granville.
