Police: Woman arrrested in deadly Phoenix DUI crash

A woman, who was pulled from her burning car by witnesses after a 2015 deadly crash, has now been arrested for causing it. 

Phoenix police report that Tuesday afternoon they arrested 46-year-old Michelle Ware for the collision at 7th Avenue and Elwood Road on February 7, 2015.

Police say Ware was at the wheel of a Dodge Charger traveling south on 7th Avenue when she crossed the center line and hit a Ford Focus killing Emilio Cruz Castro and seriously injuring two others, including a 9-year-old boy. 

Ware's Charger caught fire and two witnesses pulled her from the car. She was admitted to the hospital with numerous fractures and head trauma. After several surgeries, she was transferred to a rehabilitation facility. Police say her blood alcohol content was .243 at the time of the collision, more than three times the legal limit. 

The vehicle's airbag control module indicated the car's speed at the time of the crash was 78 miles per hour and five seconds before the crash, it was 106 miles per hour. 

Ware was arrested for aggravated assault and second-degree murder, at her home Tuesday, one day before her 46th birthday.

She appeared at her first court appearance on crutches and said she was expecting to have another court hearing in five days .
