SCOTTSDALE, AZ — A man is accused of touching himself while taking photos of women at a Scottsdale yogurt shop.

Scottsdale police report that on June 16 they responded to a yogurt shop near Hayden Road and Via de Ventura where a witness told them David James O'Brien, 57, was touching himself while taking pictures of women.

The witness is a manager of a business near the yogurt shop, who was contacted by a yogurt shop customer requesting help.

Police say O'Brien was seated at the shop and taking pictures of the women in the business including the owner, a female worker, a female customer, and a family with two small children.

According to police, the manager entered the store and found O'Brien looking at his phone with "his hands up his shorts." He described O'Brien's behavior as "creepy."

O'Brien left the store after being seen by the manager who followed him until police arrived. Police say they found O'Brien near a planter where they found a sex toy.

According to Scottsdale police, O'Brien has been contacted by them at least eight times for similar behavior at coffee shops and gyms. He has been convicted twice according to court records.

O'Brien denied his actions saying that after his previous arrests, "he is always careful when he goes out in public."

He has been charged with public sexual indecency.
