A man is accused of using a 3-foot club to injure another driver and damage his windshield.

The Department of Public Safety says that on Aug. 23 a man reported that he was the victim of a road rage incident that happened on McDonald Road just off of Loop 101.

The victim told officials he was exiting the freeway when a black SUV passed him in the right emergency lane and moved in front of his car.

Brian Matthew Melton, 43, is accused of getting out of his SUV with a 3-foot club and swinging it at the victim, according to police reports. The victim said he moved his head but the club struck his hand which was on the steering wheel. The club also hit the inside of the windshield causing it to crack.

Melton reportedly fled the scene in his SUV, however, the victim was able to get his license plate number.

On Sept. 3, DPS went to Melton's home to ask him about the incident. Melton reportedly told DPS that the victim cut across three traffic lanes, including in front of him. He said he "flipped off the driver" but denied assaulting him with a club.

DPS says they searched the SUV for the club but were unable to find anything.

The suspect was charged with aggravated assault in connection with the incident.
