Republican legislative asked the U.S. Supreme Court to overturn lower court orders requiring the state to increase funding for English language learning programs on Thursday.

A petition was filed with the high court on behalf of House Speaker Jim Weiers and Senate President Tim Bee.

The petition asks to review decisions by a federal judge in Tucson and a federal appeals court.

Both courts upheld the constitutionality of a state law requiring increase funding for the programs, which benefit about 130,000 students.

The Supreme Court has discretion to decide whether to consider the appeal.
