Surprise police investigating an officer involved shooting Saturday that killed one man

SURPRISE, AZ - Surprise police are investigating an officer-involved shooting Saturday that killed a man.

Police have identified the man as 52-year-old Joel Byne.

Police say they were called out to a home on Aster Drive near Cactus and Bullard, after a neighbor saw Byne walking down the street with a rifle threatening to kill himself.

When police arrived, he was standing in a yard holding a gun to his head threatening to shoot himself.

"They had the whole street blocked off," said neighbor Dan Dimang,

A neighbor told us Byne lived in the neighborhood about a year ago, until his ex-wife died. We're told by a close friend he took care of his ex-wife who was suffering from cancer.

After her passing, he was forced to move out of the home.

Police said they spent an hour and half negotiating with Byne. During talks, police say Byne threatened officers and that's when shots were fired.

"I heard three shots. I just got my kids out of the house. Guns were drawn. It is always sad when a life is lost," said Dimang.

According to police, Byne was transported to the hospital in critical condition where he was later pronounced dead.
