PHOENIX - Phoenix police say a man who was walking his dog in front of a fast-food restaurant was shot and killed by another man after the two got into a fight.
Police said the 22-year-old shooter, whose name they did not release, had ordered food at a Taco Bell drive-thru on Tuesday night and was told to pull his car up as he and a passenger waited for their order.
As he was pulling up, 29-year-old Daniel Adkins stepped around a blind corner and into the lane with his dog.
Police say the driver quickly stopped, but he and Adkins exchanged hostile words and got into a fight that ended when the driver shot and killed Adkins.
The driver remained at the scene and called police.
He told police that Adkins had a bat or some type of weapon that he swung at them, but detectives found nothing of the sort.
A witness told police that Adkins did swing his fist in the driver's direction several times.
It's unknown whether the driver will face any charges or if the shooting will be deemed self-defense.
