Phoenix apartment complex residents left without air conditioning

PHOENIX - Residents at a West Valley apartment complex are suffering through the heat and humidity without air conditioning.

Tenants tell us all 208 units at Bella Gardens Apartments near 51st Avenue and Thomas Road have been without A/C for days.

"You'd think they would care about the people here. Especially the elderly," said tenant Lydia Ortez.

The temperature reading inside some of the apartments registered anywhere from 90 to 100 degrees.

"I feel like I can't breathe because it is too hot,” said Ortez.

Residents are doing whatever they can to stay cool -- leaving their doors and windows open, using fans, even standing outside feels cooler than indoors.

But it's not making anyone less frustrated.

"I’m hot, tired and angry. I can't get any results. They won't help us. They won't take money off of our rent because utilities are included,” said tenant Josh Finesilver.

"This is ridiculous, we've got kids in the apartment, elderly and they don't want to do anything about it," said tenant Colleen Savage.

The leasing staff hasn’t returned our phone calls. Residents have been told the A/C could be fixed as early as Saturday or as late as three weeks.

As far as tenant rights, you aren’t allowed to withhold rent. But you can deduct portions of the money you paid to stay at a substitute service like a hotel. 

Any time you are disputing anything with your landlord, get it in writing so you will have proof later.
