William Scroggins, 34, is being held on suspicion of murder, kidnapping outside of Circle K store

PHOENIX - A suspect in a fatal shooting of a man outside a Phoenix convenience store is in custody.

Phoenix police say 34-year-old William Scroggins turned himself in to Tempe police.

He's being held on suspicion of first-degree murder, kidnapping and aggravated assault.

Investigators say Scroggins met Michael Abernathy and Abernathy's brother at a Circle K store at about 11:30 p.m. Monday to celebrate Abernathy's 35th birthday.

Police say Scroggins and Abernathy argued while at the store and Scroggins pulled out a handgun and allegedly shot Abernathy.

Officers found Abernathy with a gunshot wound outside the store. He was pronounced dead at the scene by paramedics.

Police didn't immediately know Wednesday if Scroggins has an attorney yet.
