Federal judge dismisses lawsuit over Grand Canyon Skywalk

FLAGSTAFF, AZ - A federal judge has dismissed a lawsuit that sought to keep a northern Arizona tribe from severing its agreement with the developer of the Grand Canyon Skywalk.

U.S. District Judge David Campbell did not address the claims brought by Las Vegas developer David Jin.

Campbell wrote Thursday in an order dropping the case without prejudice that Jin first must exhaust remedies in Hualapai court in Peach Springs.

The tribe approved an eminent domain ordinance in April that Jin believes is aimed at canceling his contract with the tribe. Tribal Council members dispute the contention.

Jin had filed an action in tribal court to try to force arbitration over the matter.

A tribal judge has not ruled on a request by the defendants to dismiss the tribal action.
