Off-duty Tucson police officer pulls gun on clerk (VIDEO)

TUCSON, AZ - Surveillance video has been released that shows an off-duty Tucson police officer allegedly waving a gun at a convenience store clerk.

The Pima County Sheriff's Department says 23-year-old Tucson Police Department Officer Kyle James McCartin was booked into the Pima Adult Detention Center charged with two counts of aggravated assault.

According to PCSD, Rincon District deputies responded to the Giant Gas Station around 3 a.m. on Tuesday where they were told two men entered the store wearing bullet proof vests and appeared to be very intoxicated.

While the clerk was ringing up the sale, one of the men pulled out a handgun and pointed it at the clerk.

The other man is seen telling him to put the gun away but the first man pointed the gun at the clerk a second time.

The men left the area on foot and were found a short time later at a nearby apartment complex.

Investigators learned that the man with the gun never demanded anything while pointing the gun at the clerk.

The clerk was able to give a good description of the suspects and McCartin was later identified as the man who pointed the gun at the clerk.

McCartin was hired last September and was on probationary status. He has since been fired.
