PHOENIX - A 22-year-old man has been indicted on a murder charge in the shooting death of another man at a fast-food restaurant.

Prosecutors in Maricopa County announced Friday that Cordell Lamar Jude is facing a count of second-degree murder. He's set to be arraigned Aug. 9.

Jude had been pulling up to a drive-thru window in April when 29-year-old Daniel Adkins stepped into a blind corner and into the lane with his dog.

Authorities say the two exchanged hostile words and got into a fight that ended with Jude killing Adkins.

“It's not that cut and dry and it's not that low of thresh hold,” said Maricopa County Attorney Bill Montgomery when talking about how they decide when it’s appropriated to use self defense.

A witness told police that Adkins swung his fist in the driver's direction several times.

"It's been a long waiting. Four months with nothing happening,” said Daniel Adkins, Sr., the victim’s father.

The victim’s mother, Antonia Adkins, told ABC15 she was satisfied with the decision.

In Spanish, she added: No parents want to see their child taken away from them.

"They took away part of my life that will never come back,” the father said.

Jude was booked and released from jail.
