Phoenix couple files restraining order against nine-year-old girl

PHOENIX - A Phoenix nine-year old has been hit with a restraining order, after a neighbor said she's been antagonizing them for months.

Kaitlyn Calvert, 9, received the court order Wednesday evening, said her mother, Sondra Cevelin.

"I hadn't really thought about [if it were] even possible to get a restraining order against a nine-year-old," Cevelin said.

Cevelelin told ABC15 the feud between the families started a few months ago. Cevelin said her daughter, Kaitlyn, walks her dog past the house, where her neighbors shout and scream obscenities.

"They're neighborhood bullies," Cevelin said.

The mother filed an injunction against harassment, or restraining order, against her neighbors, who live just a few houses down the road, in January.

ABC15 spoke with neighbor James McFadden, who told a different side of the story.

"I wasn't harassing anyone," he said.

McFadden and his wife, Cynthia, said the nine-year-old is the one causing all the problems, which prompted the couple to file their own restraining order, against Calvert.

"I don't dislike [those] people," he said. "I just want to be left alone."

McFadden said Calvert would break into his back yard and purposely let her dog defecate on his property and cited numerous other run-ins with the girl, which led to him filing the restraining order.

"I don't care if the kid walks down here," he said. "I don't want her coming down with the dog and pooping on my lawn, that's what this was all about."

Cevelin disagrees and so does her daughter.

"I don't think I do anything wrong," Calvert said in reference to when she walks by the home.

Cevelin and Calvert plan to fight the restraining order in court.
