Trial set for man accused of killing border agent

TUCSON, AZ - A federal judge has reset the trial date for a Mexican man charged with killing a U.S. Border Patrol agent.

The trial date for Manuel Osorio-Arellanes is now set for Feb. 5.

Osorio-Arellanes and four other men are charged with murder in the December 2010 death of Border Patrol Agent Brian Terry in a shootout near the Arizona-Mexico border.

The four other men charged in Terry's death are fugitives.

Two guns found at the scene were bought by a member of a gun smuggling ring that was being monitored in the federal government's botched gun smuggling probe known as Operation Fast and Furious.

Critics have hammered federal authorities for allowing informants to walk away from Phoenix-area gun shops with weapons, rather than immediately arresting suspects and seizing firearms.
