A Georgia mother is in big trouble for letting her 10-year-old son get a tattoo .

She says it was to honor his older brother, who died after being hit by a car.

The tattoo is of his brother's name and former basketball jersey number.

Mom reportedly has similar memorial tattoos.

Well, someone at school noticed the child's tattoo and called police.

In Georgia, it's illegal for anyone under the age of 18 to get a tattoo -- even with parental consent.

The mom -- who says she didn't know about this -- is now charged with misdemeanor cruelty and being a party to a crime.
