Lindsay Lohan wants car crash case dismissed

LINDSAY LOHAN's lawyer has asked a judge to dismiss an ongoing car crash case over claims the actress was not read her rights before cops questioned her in hospital.

The Mean Girls star has been accused of lying to police officers for allegedly suggesting she was not driving her luxury Porsche at the time of an accident in California last summer (Jun12) and the incident has left her facing probation violation charges.

Lohan's attorney, Mark Heller, has now filed a court motion asking a judge to dismiss the case over allegations the cops who questioned the actress in a Santa Monica hospital failed to issue her with a Miranda warning, which is given to suspects during a custodial interrogation to inform them their statements will be used in criminal proceedings.

In the documents, which were filed in court in California on Friday (22Feb13), Lohan claims the officers told her she was not free to leave or receive further medical treatment until she answered their questions, according to the New York Daily News.

Lohan's probation stems from her 2011 necklace theft conviction and she has pleaded not guilty to a violation charge.
