IN ARIZONA IF YOU GET PULLED OVER FOR "DUI" YOU WILL GET YOUR CAR TOWED AND IMPOUNDED FOR 30 DAYS--- YOU WILL NOT GO TO JAIL--- YOU WILL HAVE TO APPEAR IN COURT AND YOU WILL GET TIME THERE BUT UPPON INITIAL PULL OVER YOU WILL NOT GO TO JAIL!

The officer was released and is doing fine, said Samudio. The driver was under the influence and alcohol was a factor, according to Samudio. It is unknown at this time if speed was a factor. " The driver was not arrested and allowed to leave the hospital on his own recognizes? There was alcohol involved and no arrest? Lets let him get drunk again and kill someone this time. I don't understand this!

Whether or not the officer was speeding or at fault, it doesn't matter. The offending driver should not have been driving impaired. As for taking an officer's word over a citizen, uh that's not likely to be the case. If the officer was responding to a call with his emergency lights on, then the impaired driver is SOL. Don't assume the officer isn't at fault - he'll have to face his peers, so relax people. Officers are humans first - whether you want to believe it or not.

How do you determine the cop ran the light from that picture ?? Do you think it possible that he was travelling through the intersection and hit his brakes when he saw the other vehicle running the light entering the intersection about to hit him? Skid marks do NOT provide evidence of the light color at the time of impact.

From what I can tell from the impact, the cop got hit in the middle of the intersection. The skid marks indicate this, so the cop ran a red light and Jose hit him. But....jose was impaired by alcohol so he shouldn't have been driving which means he gets an all expence paid vacation to Club Tent City. Ahhh, nothing like R&R in the tents in the middle of the summer with monsoons coming right thru the holes in those tents and soaking his bunk.

It doesnt appear that ANYONE was stopped by what is seen in these pics; it does reflect a front right corner impact with the left front corner of the green sedan, indicating not a T-bone, but possiblly the PD vehicle crossing the intersection and the green sedan entering from the right, striking corners with each, and the resulting ending place of both vehicles to support that.

I find it hard to beleive that the officer was stopped behind the line at a red light and the guy T-boned him. If they guy ran a red light he would have missed the officer by 20 feet or so. I think the officer ran the red light and the guy hit him. But because we are to beleive the word of an officer and the state will, they guy is screwed.

missy66,Well if the other was under the influence which it said he was & the officer was stopped at a red light, I must say that the other guy is at fault.
