Click the play button on the video window to the see the storyPHOENIX, AZ -- Khali Freymuth says she was confused when she received a notification letter from The Ahwatukee Board of Management, her homeowners association, in June.
“[It was] reminding us we’re not supposed to park on the street, which was news to us,” said Freymuth.
She lives in the Center Court neighborhood in Ahwatukee. She's lived there for 19 years.
During those years Freymuth says she and her neighbors have been parking on the street in front of their homes daily, up until a few months ago.
“It conflicts with normal daily life. You can’t play basketball in your driveway. You can’t stage a garage sale,” said Freymuth.
Board President Christopher Gentis says the rule isn’t new.
“There’s a CC&R that talks about utilizing your garage space first for vehicle parking, then your driveway, then the street,” said Gentis.
He said every homeowner agreed to those regulations when they signed them after buying the home 19 years ago. He also says there’s been no change in enforcement.
“If that’s the case then why do residents like me, and there are many of us, who’ve lived here the whole time, that are not aware of any such prohibition," asked Freymuth. "The rules do not state that you can’t park on the street."
But Gentis says they are mistaken.
“What they believe and what it is, is apparently two different things,” he said.
If homeowners do not comply they can be billed for legal fees the board may rack up while trying to enforce the rule.
Freymuth says after some loud complaining, residents' requests have put the matter on the agenda for a meeting Wednesday night at 6:30 p.m. The meeting will be held at the Ahwatukee Board of Management Office at 4700 E. Warner Road.
It’s there Freymuth is hoping for some resolution, but Gentis isn’t optimistic.
“I don’t have any hope. I don’t know why we’re at this point,” said Gentis.
