Maricopa County Supervisor Donald Stapley is one step closer to standing trial on 114 criminal counts.
Judge Kenneth Fields shot down Stapley's request to have the case remanded to the Grand Jury.
Stapley was indicted back in December of 2008 on charges that included perjury and failing to disclose financial investments to the public.
According to County Attorney Andrew Thomas, an investigation found Stapley failed to disclose multimillion-dollar parcels of land in Maricopa and Pinal County, hundreds of thousands of dollars in personal and business bank accounts, leadership positions in Arizona corporations, and many other financial holdings and dealings.
Stapley had claimed prosecutors with the Maricopa County Attorney's Office presented "false and misleading testimony or evidence" to the Grand Jury.
He also said prosecutors made "material omissions of evidence" and failed to present evidence on some of the criminal charges.
But the judge clearly disagreed.
In his ruling, Judge Kenneth Fields, stated, "the evidence challenged by defendant as false and misleading is more correctly viewed as a dispute between the parties as to the quality and weight of the evidence."
The judges ruling goes on to state, "this Court can not find that the prosecutor deliberately or negligently mislead the Grand Jury as to the evidence or law."
One more motion is still pending before the Court.
Stapley's attorney's have filed a motion to have the entire case dismissed.
