"Everybody is getting ticked off about it," said homeowner Vernon Couch.
Among other things, the residents of Desert Carmel are upset about the condition of their subdivision.
"You can't go down this road without going around 50 pot holes," said Couch.
About 100 homes are built here on 3,500 lots. Sixty of those homeowners are suing the association that governs them.
"We could not believe in a million years some of the stuff they've been pulling on us," said homeowner Kathie Vines.
Vines claims the few owners of the 3,400 empty lots have taken control of the board and are using the assessment money illegally.
"They spent our money on themselves buying more property," said Vines.
Shawn Lampman is the president of the association. His lawyer says Lampman just wants the best for the development.
"We have not seen any evidence of any type of conspiracy to do any harm to any of the owners down there," said Tim Thomason who is an attorney for the association.
The lawsuit alleges Lampman and his partners own the empty lots. They elected themselves as the association board and make decisions that benefit them, not the homeowners.
"They're like gangsters," said Vines.
The association's lawyer claims there is no wrong doing. He says the subdivision isn't up to par because of a lack or funds coming in.
"They have very limited resources and because not a lot of people live there there's only so much money that can be spent on that place," Thomason said.
